What is a residence order?

A residence order is an order from the court to say who the child should live with. A court can order a joint residence order, which is an order to say that the child shall spend time living with both parents.

A residence order usually expires when the young person reaches the age of 16, in some exceptional circumstances the order can last until the young person is 18.

If a residence order is granted through the court, parental responsibility will automatically be given to any person in whose favour the order is made.

This parental responsibility will terminate when the order terminates, usually at the age of 16, unless the order has been made in favour of the biological father, in which case parental responsibility will last until the young person reaches 18 years of age.
