The parents should be able to decide where the child should live regardless as to whether or not the parents are or were married. It may be that an unmarried father does not have parental responsibility; if this is the case it is advisable to obtain it.

If parents are married but are in the process of divorcing, there is a provision in the divorce proceedings which discusses the arrangements for children.
