What happens when a child wants to live with the other parent?
This will depend on the individual circumstances and the reactions of those involved.
If there is a residence order from the court, then it should be abided by. However, if everyone is happy about the change in residence then parents can keep it informal and there is no need to apply to court to get it amended.
If the resident parent is not happy about the situation then it may be an idea to go through the courts to get the residence order changed. That way no one is acting in contempt of court or could threaten further legal action.
If there is not a residence order in force then there should not be a problem. If both parents are happy with the arrangement then there is no need to formalise the agreement by going through court. However, if the parent is not happy about the child’s change of mind, then it may be an idea to apply to the court for a residence order.
