Child Witnesses Questions and Answers

Does my child need to take an oath?

Does my child need to take an oath?

Children under the age of 14 do not have to take the oath. For those over the age of 14 the court will decide whether the child should take an oath, depending on whether the child understands the seriousness of the occasion and the necessity to tell the truth. Children who have no religion will be asked to affirm, which is a declaration that they will tell the truth.
