Child Witness
Child Witnesses Questions and Answers

Does my child have to be a witness if summoned?

I have received a witness summons asking my child to go to court. Does he/she have to go?

If a child has received a witness summons to appear in court as a witness, he or she must go. The child must give evidence as it is an order from the court. If he or she fails to do this they would be acting in contempt of court. Children of any age can give evidence if they can give ‘intelligible testimony’ (i.e. that they understand the questions and can answer in a way which can be understood by the court.)
